Terms of use for offers of the e-learning portal of the Rottenburg University of Applied Forest Sciences.

1 Scope of application

These terms of use apply to all offers within the framework of the e-learning portal of the Rottenburg University of Applied Forest Sciences (ELP).

2 Offer

The e-learning portal is a service offered by the Rottenburg University of Applied Forest Sciences. The offer is aimed at members and affiliates of the university, part of the offer is freely accessible.

Access to and use of the documents are subject to the terms of use described below. You will only be granted access and use if you recognise these terms of use.

3 Copyrights

You acknowledge that the information, texts, software, images, videos, graphics, sound and other materials contained in the e-learning portal of the Rottenburg University of Applied Forest Sciences are protected by copyright, trademark or patent rights and that the copyrights and exploitation rights belong exclusively to the respective licensors. You undertake to comply with the statutory provisions of copyright, trademark and patent law.

4 Location and amendment of these terms of use

(1) The text of these terms and conditions can be viewed online on the main page of the ELP as well as on the entry pages for the systems and as an attachment to the registration form for new registrations.

(2) The university is authorised to amend these conditions at any time. The amendments shall enter into force as soon as they have been published online. By continuing to use the offer, you agree to the amended terms of use and are bound by their provisions.

5 Modification of the offer

Rottenburg University of Applied Forest Sciences may change or suspend parts or certain functions of the website at any time without prior notice. Accordingly, it may at any time restrict the use of and access to the offerings as well as the duration and scope of use.

6 Warranty and product liability

(1) The Rottenburg University of Applied Forest Sciences makes the systems available for use "as they are". No specific properties are expressly guaranteed. No guarantee is given for the absence of errors. No guarantee is given that the platforms are suitable for the purposes of the users and that they will co-operate with existing software. Rottenburg University of Applied Forest Sciences is not liable for any damages arising from the use of the platforms.

(2) The Rottenburg University of Applied Forest Sciences does not guarantee the correctness and completeness of the content provided. No liability is accepted for direct or indirect damage resulting from incorrect content.

(3) The Rottenburg University of Applied Forest Sciences does not guarantee that the data uploaded will be backed up. Users are responsible for ensuring that their data is suitably backed up elsewhere. No liability is assumed for the loss of data or any resulting consequential damage.

(4) The Rottenburg University of Applied Forest Sciences does not guarantee the availability of the systems or specific content for a specific time or period. No liability is assumed for damages caused by the unavailability of the systems or content. However, the Rottenburg University of Applied Forest Sciences endeavours to keep downtimes as short as possible and to ensure that all functions are available at all times.

(5) You expressly agree that the use of the systems and their content is at your own risk.

7 Registration (login) and access code

(1) The university offers information, knowledge objects and learning programmes for members and affiliates of the university on the learning platforms. Guests can only be granted access to the learning platforms in consultation with a responsible lecturer and for a limited period of time. You confirm that your registration details are correct and that you will correct them immediately in the event of any changes.

(2) You confirm that you will not disclose your ID, password or course key to anyone and recognise that you are responsible for any use of the learning platform that is carried out using your ID and password. You are obliged to inform the administration immediately if you notice or suspect any misuse of your access data.

8 End of the authorisation of use

(1) The authorisation to use the learning platforms expires as soon as you leave the Rottenburg University of Applied Forest Sciences or after the expiry of the time limit.

(2) The university may suspend access to the systems in part or in full or terminate your authorisation to use them if the systems are used under your ID and password, whether by you or by a third party, in a manner which, in the opinion of the Rottenburg University of Applied Forest Sciences, constitutes a breach of these terms and conditions or which may otherwise be detrimental to the university.

9 Use of information and materials

(1) Responsibility for the course content lies with the respective lecturers. They can nominate employees who are also authorised to provide materials. The providers of the contents shall ensure that the content is used in accordance with these terms of use by assigning appropriate access authorisations. The respective users are responsible for contributions posted, data provided and other content, including in the context of communication functions. The Rottenburg University of Applied Forest Sciences is not obliged to monitor the content posted by lecturers, their employees or users in any way.

(2) The right of access and use granted to you on the learning platform is not transferable and is only available to you. You are authorised to use the materials accessible to you on the learning platform to the extent offered (e.g. to read, download, print). This right exists exclusively for your personal use in the context of teaching, learning and research at the university and expressly not for commercial purposes.

(3) You undertake not to reproduce, use, sell, transfer, publish or otherwise make available the materials and contributions of other users for other purposes, including in postings to external newsgroups, mailing lists, electronic noticeboards and the like.

(4) The communication systems belonging to the learning platforms may not be used for advertising or other tasks unrelated to the purpose of the offer. Passing on the e-mail addresses of other users registered in the system is not permitted.

10 Data protection

(1) Personal data is processed on the learning platforms. These are used exclusively to ensure the functions of the platform. It is not used for other purposes or passed on to other organisations.

(2) The relevant data protection regulations of the LDSG (state data protection law) Baden-Württemberg shall apply.

(3) By logging in or registering with the platform, you consent to the processing of your personal data.

(4) You can freely revoke this consent at any time. Any further use of the platforms is thereby excluded.

(5) The Rottenburg University of Applied Forest Sciences reserves the right to collect anonymised tracking information for the following purposes:

Improving the university's programmes and services;
Measurement of data traffic volume;
Identification of usage patterns;
Inform teachers about the usage statistics of their courses.

In the event of such tracking, the user will be informed of this within the corresponding offer.

11 User account blocking and user account deletion

(1) The user account will be deactivated two years after the user's last login.

(2) A user account will be deleted one and a half years after deactivation of the user account if no application for reactivation of the account is submitted. A corresponding request can be submitted by email to support@hs-rottenburg.de.
